Chapter 01

ARTICLE 2 (Ambit)

01 The present Law is applicable to the generation, transmission, distribution and commercialization of electric energy throughout the territory of the Republic of Mozambique, as well as its import and export.

02 The use and exploitation of the energetic sources for different purposes of electric power generation shall be subject to a specific legislation.

 

ARTICLE 3 (Objectives)

This law aims at defining objectives concerning electric energy:

a) the general policy organisation of the sector and electric energy supply management;

b) the general legal regime of the electric power generation, transmission, distribution and commercialization activities in the territory of the Republic of Mozambique, as well as its importation and exportation and the concession regime of such activities.

 

ARTICLE 4 (State’s Role)

01  The State, its institutions and further public law collective persons have a determinant action in the promotion of rising the value of the existing potentiality in order to allow more and more access to the benefits of electric power, thus contribute to the social and economic development of both the country and the region.

02 The State ensures the engagement of the private sector initiative in the public services of electric energy supply through concessions that ensure the right of use and benefit of the energetic potential, safeguarding the State’s upmost interest.

 

ARTICLE 5 (Organisational Policy and management)

01 The general organisational policy of the sector and electric energy management aims at:

a) Exploiting the resources and existing potential to the full and contribute to the social and economic development of both the country and the region;

b) Promoting the extension of the national electric energy network nationwide in order to ensure access to the benefits and availability of electric power to people and entities which are not connected to the nation electric energy network as yet;

c) Ensuring effective supply of quality electric energy to the consumers and in competitive and just terms;

d) developing both the nationwide energetic readiness and the electric energy network in order to boost the social and economic development and ensure electric energy supply to the consumers’ needs, securing an ecologic balance, the conservation and environment protection;

e) Seeking alternative technologies of electric power supply;

f) Supplying electric power as a public service;

g) Ensuring the public sector engagement to exercise the public service with a vocation for electric power supply;

h) Create a favourable atmosphere for the participation of the private sector to exercise the public service of electric power supply.

  

ARTICLE 6 (Competence)

The Cabinet Council shall:

a) pass the resolutions on electric energy supply schemes of installed power of 100 MVA or more;

b) set competency regarding who grants the supply rights of electric energy at different levels;

c) Exert other attributes that are granted by the present law and further applicable legislation.
